These images may not be copied, distributed, altered or used in any manner other than as listed in the below End User License Agreement and without purchasing a license or obtaining written permission from Leah Cole, LLC or the copyright owner.
You may not publish an image from this site (even if altered) without purchasing a license or with the express written permission of Leah Cole, LLC. This includes but is not limited to; free sites, personal sites, and not-for-profit sites.
Images displayed on the site may be digitally watermarked for tracking purposes.
Leah Cole, LLC End User License Agreement (EULA)
The following is a legal agreement between you and Leah Cole, LLC. Please read this agreement carefully before downloading any Leah Cole, LLC Image ("Image"). By downloading any Image, you agree to be bound by the terms of this agreement.
- All Images are copyrighted. Leah Cole, LLC or its suppliers own all rights to the Images. All rights are reserved by Leah Cole, LLC unless otherwise granted to you. Your rights to use the Image are subject to this agreement.
- By this Agreement, Leah Cole, LLC grants you a personal, non-exclusive, non-transferable, one time use to reproduce Images in the following ways:
1. On web sites, multimedia presentations, and broadcast film and video.
2. In magazines, newspapers, pamphlets, brochures, editorials.
3. as decoration in office, restaurant, public area, home, or store.
4. All other rights in the Images are expressly reserved by Leah Cole, LLC for itself and on behalf of the respective copyright holders.
- You may NOT:
8. Use or display any Image on websites designed to induce sales of "print on demand" products, including postcards, mugs, t-shirts, posters and other items (this includes custom designed websites as well as sites such as Cafe Press (i.e. www.cafepress.com).
9. Use an Image other than as specified in the preceding section.
10. Use an Image with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon the trademark or intellectual property of any third party.
11. Use or display an image as part of or in connection with the promotion or marketing of any audio-visual work with a viewership of more than 250,000, including, without limitation, any documentary, news show, television program or film, in any media, without the prior written consent of Leah Cole, LLC.
12. Use an Image in a way that places a person in the photo in a bad light or depicts them in a way that they may find offensive- this includes pornography, tobacco ads, religious and political endorsements, defamatory, or otherwise unlawful or immoral content.
13. Resell any Image.
14. Share an Image by providing access on shared disk drives or network.
15. Use Leah Cole, LLC images to compete with Leah Cole, LLC. This includes, by way of illustration, not by way of limitation, displaying images in any format (including thumbnails) for download on a website. Offering Leah Cole, LLC Images for sale, or including Leah Cole, LLC Images in templates for sale. You may not, for example, create an entire greeting card line based on Leah Cole, LLC images - or use our Images as the basis for a large collection of objects for sale.
16. Use the Image in a website template that you plan to sell or transfer to others.
17. Use any Image as part of a trademark or patent image.
18. Use any Image as part of a logo.
19. Produce printed reproductions of any Image on canvas or paper to be sold.
- "Non-transferable" as used herein means that except as provided in this EULA, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone the Image or the right to use the Image.. In addition, the work you produce with the Image must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Image. This may include invisibly watermarking the image and identifying that Leah Cole, LLC owns the image on the document you intend to use the Image.
- If you plan on using images for client work, you must keep accurate and detailed records of which clients you have used images/photos for and pay a license fee for each client.
- You agree that you will not share your username and password combination. The username and password you use to purchase an Image is to be used only by you. We reserve the right to monitor accounts and institute mechanical or other means to stop users from sharing their login information.
- You agree to indemnify and hold Leah Cole, LLC, Inc., its officers, employees, shareholders, directors and suppliers harmless against any damages or liability or any kind arising from any use of the Image other than the uses expressly permitted by this Agreement.
- Neither Leah Cole, LLC or any of its directors, officers, employees, partners, licensors, or agents shall be liable for any damages, whether direct, indirect, consequential, or incidental, arising out of the use of, or the inability to use, any Image or Images.
- This Agreement shall be governed by the laws of the State of Virginia. The venue of any action respecting this Agreement, any Image, or use thereof, shall be in the state of Virginia and county of Hanover and not elsewhere.
- Additional rights to Images are available. If you are unsure of your rights under this agreement, or if you wish to use an Image in a matter not expressly permitted under this agreement, please contact Leah Cole, LLC Support for a special license. In most cases we can provide a license upgrade within 24 hours.
- Leah Cole, LLC makes no representations or warranties whatsoever as to the legality or validity of any Release associated with an Image.
- Leah Cole, LLC makes no representations or warranties whatsoever with respect to the use of names, trademarks, logos, uniforms, registered or copyrighted designs or works of art depicted in any Image.
- You must satisfy yourself that all necessary rights, consents or permissions as may be required for Reproduction of any Image have been secured by you.
1. A "derivative work" is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications that, as a whole, represent an original work of authorship, is a "derivative work."
